Terms of Use

These Terms of Use (“Terms”) govern access to and use of the IndiHomes website, customer accounts, content, features, and the purchase of products offered through this store (collectively, the “Services”). IndiHomes is operated as an individual business in India. By accessing the Services, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

Nothing in these Terms excludes or limits any right, remedy, guarantee, or protection that cannot lawfully be excluded under applicable Indian law.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to create an account or place an order. By using the Services, you represent that you meet these requirements. A person acting for another individual or organisation represents that they have authority to bind that person or organisation.

2. India-Only Store

IndiHomes currently sells and delivers only within India to serviceable PIN codes. We do not accept responsibility for orders routed, exported, or forwarded outside India after delivery to the Indian address supplied by the customer.

3. Store Information

IndiHomes offers home, kitchen, organisation, cleaning, décor, and related consumer products. Product availability, pricing, delivery serviceability, payment methods, and promotions may vary. Information on the website is provided for shopping and general informational purposes and should not replace product instructions, safety warnings, or qualified professional advice.

4. Customer Accounts

You may create or use a Shopify-powered customer account. You are responsible for providing accurate information, maintaining the confidentiality of your login method and devices, and promptly notifying us of suspected unauthorised access. You are responsible for activity conducted through your account to the extent permitted by law.

We may suspend or restrict an account where reasonably necessary to protect customers, prevent fraud, comply with law, investigate misuse, or secure the Services. We will not use suspension to avoid a valid consumer complaint or refund obligation.

5. Accuracy of Customer Information

You must provide complete and accurate contact, billing, delivery, and payment information. You should update information before placing an order. IndiHomes is not responsible for delays or failed delivery caused by inaccurate customer information, except where responsibility cannot legally be excluded.

6. Products and Descriptions

We aim to present product titles, images, colours, dimensions, materials, capacity, compatibility, features, safety information, and included components accurately. Display colours and apparent scale can vary by device, lighting, photography, and screen settings. Minor variations that do not materially change the advertised product may occur.

Customers must review dimensions, voltage, compatibility, material, installation, care, intended use, and safety information before purchase. If information is materially inaccurate or a product is defective, unsafe, incorrect, spurious, or materially different from its description, applicable remedies remain available under our Return, Replacement and Refund Policy and Indian law.

7. Product Availability

Products are subject to availability. Adding a product to a cart does not reserve it. Supplier or inventory information can change before fulfilment. If an ordered product becomes unavailable, we may offer a replacement with your agreement or cancel the affected item and refund the amount paid for it.

8. Prices, Taxes and Errors

Prices are displayed in Indian Rupees unless stated otherwise. Applicable taxes, shipping charges, cash-on-delivery fees, discounts, and other charges will be displayed before order submission where required. We may correct an obvious typographical, technical, or pricing error before accepting an order. If payment has already been collected for an order we cannot lawfully or reasonably fulfil at the displayed terms, we will notify you and provide an appropriate refund or choice where applicable.

9. Promotions and Discount Codes

Promotions may have eligibility periods, product exclusions, minimum values, quantity limits, customer limits, or other conditions shown with the offer. Unless expressly stated, promotions cannot be combined, exchanged for cash, transferred, or applied retrospectively. We may cancel a promotion affected by fraud, technical error, or unlawful conduct, but will honour valid consumer rights relating to completed orders.

10. Payment Methods

We may accept prepaid payments, UPI, cards, cash on delivery, and other methods displayed at checkout. Available methods can vary by order, destination, risk review, or payment-provider availability. Payment processing is provided by Shopify and third-party payment providers under their applicable terms.

You represent that you are authorised to use the selected payment method. We may delay or cancel an order where payment fails, is reversed, appears unauthorised, or triggers reasonable fraud concerns. We will not request card PINs, online-banking passwords, or unrelated one-time passwords by email or support message.

11. Cash on Delivery

Cash on delivery is available only where shown at checkout and may require confirmation. COD may be restricted based on serviceability, order value, product type, or repeated refusal of genuine deliveries. Any COD fee will be disclosed before purchase. COD restrictions will not prevent a customer from raising a genuine complaint.

12. Order Submission and Acceptance

An order confirmation acknowledges receipt of your order but does not necessarily mean final acceptance. An order is accepted when we begin fulfilment or dispatch, unless applicable law provides otherwise. We may reject or cancel an order for unavailability, payment failure, suspected fraud, obvious error, serviceability restrictions, legal prohibition, or inability to fulfil. Any amount collected for a cancelled item will be refunded appropriately.

13. Order Changes and Cancellation

You may request a cancellation, address change, or other amendment before dispatch by emailing support@indihomes.store. Requests are not guaranteed after fulfilment begins. After dispatch, cancellation for change of mind is normally unavailable. Delivery refusal may be treated according to our Shipping and Delivery Policy and applicable law.

14. Shipping and Delivery

Orders are generally delivered within 3–5 days after confirmation under normal conditions, subject to serviceability, courier operations, and events outside reasonable control. Delivery estimates, tracking, multiple shipments, failed delivery, return to origin, lost parcels, transit damage, and shipping-related refunds are governed by our Shipping and Delivery Policy, which forms part of these Terms.

15. Returns, Replacements and Refunds

Returns, replacements, exchanges, claim evidence, inspections, exclusions, and refund timing are governed by our Return, Replacement and Refund Policy, which forms part of these Terms. Visible damage, missing contents, or an incorrect item should normally be reported within 3 calendar days after delivery. Approved refunds are generally initiated within 5–7 business days after approval and any required return inspection. These operational periods do not remove non-waivable statutory rights.

16. Product Safety and Instructions

Read and follow all labels, assembly steps, capacity limits, electrical requirements, cleaning instructions, age guidance, and safety warnings supplied with a product. Stop using a product and contact us if you reasonably believe it is defective or unsafe. IndiHomes does not exclude liability for unsafe or defective goods where exclusion would be unlawful.

17. Customer Communications

We may send service communications required to administer accounts and orders, including confirmations, payment notices, tracking updates, delivery information, security alerts, returns, and support responses. Where you provide valid consent, we may also send marketing through email, SMS, WhatsApp, or other channels. You can withdraw marketing consent through the method provided in the message or by contacting us; transactional messages may continue where necessary.

18. Reviews and User Content

If you submit a review, photograph, video, question, feedback, or other content, you represent that it is truthful, based on genuine experience where claimed, and does not unlawfully infringe another person’s rights or reveal sensitive personal information. You grant IndiHomes a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, and display that content in connection with the Services and marketing, subject to applicable law and platform rules.

We may moderate or remove content that is fraudulent, unlawful, abusive, irrelevant, misleading, infringing, contains personal data, or violates platform rules. We will not suppress genuine criticism merely because it is negative.

19. Acceptable Use of the Website

You must not use the Services to commit fraud, impersonate another person, interfere with security, introduce malicious code, scrape protected information without permission, make false claims, manipulate reviews, conduct payment abuse, violate intellectual-property rights, or engage in unlawful activity. This section concerns use of the website and transactions and does not prohibit lawful resale of products.

20. Intellectual Property

The IndiHomes name, website design, text, graphics, logos, product presentation, and original content are owned by or licensed to IndiHomes and are protected by applicable law. You may use the website for personal and lawful shopping purposes. No ownership rights are transferred to you. Third-party names and marks remain the property of their respective owners.

21. Third-Party Services and Links

The Services rely on Shopify and may integrate with payment providers, couriers, fulfilment partners, analytics providers, advertising platforms, messaging services, and other third parties. Third-party websites and services are governed by their own terms and privacy notices. We are responsible for our own legal obligations and do not disclaim responsibilities that cannot lawfully be transferred.

22. Privacy

Our Privacy Policy explains how personal data is collected, used, disclosed, stored, and protected, including data used for customer accounts, orders, payments, shipping, support, email, SMS, WhatsApp, Meta advertising, and Google services. By using the Services, you acknowledge that you have been provided access to that policy.

23. Service Availability

We aim to keep the Services available and accurate, but maintenance, technical failure, third-party outage, cyber incident, or events outside reasonable control can interrupt access. We may modify or discontinue non-essential website features. This does not cancel an accepted order or remove an existing customer remedy.

24. Disclaimer Subject to Law

To the maximum extent permitted by law, the Services are provided on an “as available” basis, and we do not guarantee uninterrupted website operation or that every non-material error will be corrected immediately. Products remain subject to express descriptions, applicable warranties, and statutory guarantees. Nothing here excludes obligations relating to product safety, defects, misrepresentation, negligence, fraud, or other liability that cannot lawfully be excluded.

25. Limitation of Liability

To the maximum extent permitted by law, IndiHomes is not responsible for indirect or consequential loss that was not reasonably foreseeable and is not caused by our breach, negligence, fraud, defective goods, or unlawful conduct. Where liability can lawfully be limited, it will be limited to a reasonable amount connected with the affected transaction. This clause does not limit compensation, product-liability remedies, refunds, or other relief that a consumer forum or applicable law may award.

26. Indemnity

To the extent permitted by law, you are responsible for direct losses reasonably caused by your fraud, intentional unlawful conduct, malicious interference with the Services, or infringement of another person’s rights. This clause does not make a consumer responsible for losses caused by IndiHomes, defective goods, unfair terms, or circumstances outside the consumer’s reasonable control.

27. Grievances

For consumer grievances, email grievance@indihomes.store. Include your name, order number, contact details, a clear description, and supporting evidence. For routine order or product assistance, email support@indihomes.store. We will handle complaints within periods required by applicable law.

28. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to non-waivable consumer-forum rights and any forum available under applicable law, courts of competent jurisdiction in Chennai, Tamil Nadu, India will have jurisdiction over disputes relating to these Terms or the Services. Nothing in this clause prevents a consumer from using a forum or remedy that cannot legally be waived.

29. Severability and No Waiver

If a provision is found unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A delay in enforcing a right does not waive that right.

30. Changes to These Terms

We may update these Terms for legal, regulatory, security, or operational reasons. The version applicable when an order is placed generally governs that order, except where a later version is required by law or is more favourable to the customer. Continued use after an update applies to future use and transactions.
